In August 2011, the Supreme Court Appeal Panel granted permission to appeal the Court of Appeal's decisions in the jointly heard cases of Pitt and another v Holt and another; Futter and another v Futter and others [2011] EWCA Civ 197. The Supreme Court will hear the appeal in February 2012

Following the introduction of the Perpetuities and Accumulations Act 2009 in 2010 the law of perpetuities and accumulations in England and Wales is clear. However, the rules are different in both Northern Ireland and in Scotland, and difficulties persist as the pace of reform of trust law in those jurisdictions is different.

In Chisholm v Chisholm (2011) WTLR 187 the Court agreed to rectify a deed of trust under which the beneficiary's entitlement was delayed until age 25. Although this was what the settlor wanted, it also meant that a relevant property settlement was created - which is not what the settlor wanted, as the settlor's intention was to make a PET by creating a bare trust.
